Healthier Nation Initiative Discount Card Terms and conditions

INTERPRETATION

  • In this agreement
    “Discount Card” means a discount card obtained, directly or indirectly, from Healthier Nation Initiative;
  • “Retailer” means a restaurant, store or other provider of goods and/or services who is registered to accept a Discount Card;
  • “HNI” means Healthier Nation Initiative Inc., a company;
  • “You” or “you” means a recipient of a Discount Card (who shall be a person recognised as a member with HNI through the application process).

1. Introduction

1.1. The terms and conditions set out below apply to the provision to you by HNI of the Discount Card and the use by you of your Discount Card.

1.2. Please read these terms and conditions carefully.

1.3. Once you have received your Discount Card you signify your agreement to be bound by these terms and conditions by using your Discount Card.

1.4. The Discount Card is supplied to you on the basis of the information supplied to us by, or on behalf of, you in your Application Form. HNI reserves the right to immediately and without notice cancel your Discount Card at its absolute discretion for any reason whatsoever including, inter alia, if any information supplied to HNI by you is incorrect or misleading.

1.5. HNI reserves the right to amend these terms and conditions at any time by publishing a notice on its website to that effect.

2. Expiry date and delivery of the discount card

2.1. The Discount Card will be valid for one year from the date of purchase, which is to be printed on the back of the Discount Card. The discount card will be delivered via postal mail within ten (10) business days of purchase.

3. Using your discount card at participating restaurants and stores

3.1. HNI will use reasonable endeavours to maintain a list of those Retailers participating in the discount scheme on the HNI website but HNI does not warrant that any Retailer remains a participant or will accept a Discount Card.

3.2. Subject to these terms and conditions, on presentation of your Discount Card, participating Retailers will offer 5-10% off your total individual food bill or 5-10% off the total price of personal purchases, as the case may be. Retailers reserve the right to refuse the Discount Card and the application of any discount for some or all of their goods and/or services at their absolute discretion.

3.3. Please check the terms and conditions of the particular offer you are interested in before making a purchase.

3.4. Where a Retailer requires you to pre-book (e.g. restaurant) you should state at the time of booking that you intend to use the Discount Card.

3.5. At a Retailer where you pay for goods after use (e.g. restaurant), with or without prebooking, you should inform the Retailer that you intend to use the Discount card prior to the receipt of relevant goods/services.

3.6. In all other circumstances you must inform the Retailer that you have a Discount Card immediately prior to the point of purchase (e.g. at the till).

3.7. The use of your Discount Card does not apply to goods and services already discounted or already on special or to special promotions of the goods and services of HNI partners.

3.8. The expiry date of your Discount card will be checked by participating Retailers when you redeem the offer. Expired Discount Cards will not be accepted.

3.9. Your Discount Card is strictly non-transferable and so cannot be used by either friends or family members or other third parties. Participating Retailers may ask you to show photo identification such as a driving licence or National ID to confirm that you are the Discount Card holder or are permitted by law to make any acquisition. Any attempted misuse of the Discount Card will result in cancellation of the card.

3.10. Participating Retailers are entitled to withdraw their offer or change the terms and conditions of their offer from time to time. HNI shall have no liability for any such withdrawals or changes in their terms and conditions.

4. Refund and returns

4.1. All payments made to Healthier Nation Initiative are final. The Healthier Initiative Discount Card cannot be returned or refunded once the card has been printed.

4.2. Lost, stolen or damaged card(s) must be reported and can be replaced at any time during your membership term for a fee of $20.00BDS.

5. Liability

5.1. HNI will not be responsible for any indirect losses, consequential, exemplary, special or punitive damages, lost opportunities, loss of profits, anticipated profits, actual or anticipated savings.

5.2. HNI does not limit its liability at law for fraudulent misrepresentation or for death or personal injury caused by negligence or any other type of liability which cannot by law be excluded or limited.

5.3. Where you make a purchase using your Discount Card from any participating Retailer, any losses or liability arising out of or in connection with such purchases shall be the relevant participating Retailer’s liability. HNI does not accept liability for unsatisfactory experiences or any failure by the participating Retailers to deliver expected goods or services or the quality thereof.

5.4. HNI will not be under any obligation to become involved in any dispute between you and any participating Retailer. Any complaints should be taken up with the participating Retailer.

5.5. HNI does not give any warranty for any goods or services purchased with use of the Discount Card.

6. Waiver

6.1. Failure by HNI to enforce any of these terms and conditions will not prevent HNI from subsequently relying on or enforcing them.

7. Severability

7.1. If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

8. Third party rights

8.1. A person who is not party to these terms and conditions shall have no rights under or in connection with it under the Contracts.

9. Entire Agreement

9.1. These terms and conditions constitute the whole agreement between us and supersede all previous discussion, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions.

9.2. Each of the parties agrees that it has not entered into these terms and conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these terms and conditions or not) other than as expressly set out in these terms and conditions.

10. Law and jurisdiction

10.1. This agreement shall be interpreted in accordance with Barbadian law and will be subject to the non-exclusive jurisdiction of Barbados.
